Sides with Samsung in a Patent Suit

A Russian court has allowed Samsung Electronics to continue to sell 61 models of smartphones in Russia in a patent suit filed by a Swiss financial services company.

A Russian court has dismissed a claim filed by a Swiss financial services company asking for a ban for Samsung Electronics on importing and selling 61 models of smartphones in Russia.

The claim was filed by SQWIN SA, a financial services and mobile payment company based in Neuchatel, Switzerland, in a patent suit pertaining to Samsung Electronics' Samsung Pay system.

The Swiss company claimed that Samsung Pay infringes on its electronic payment system patent registered in Russia. 

In an October ruling, a Russian court prohibited Samsung Electronics from importing and selling 61 smartphone models in Russia. But the ban did not come into effect, as Samsung appealed it.

 

Then, the Swiss company sought interim court measures banning Samsung from importing and selling the 61 smartphone models in Russia.

But the Moscow Arbitration Court refused to impose the ban in a ruling on Jan. 27, saying that SQWIN SA had failed to show that Samsung had acted in bad faith.

The court's latest action did not put an end to Samsung's legal dispute with the Swiss company, but it allowed Samsung to continue to sell the 61 smartphone models, which include not only premium phones such as the Galaxy Z Flip series and the Galaxy S21 series but low-end models such as the Galaxy J5.
