Corrective Measures Still Have Room for Improvement

The Korean Fair Trade Commission has again put off making a “consent decision” regarding Apple Korea's alleged abuse of its market dominating position against Korean carriers.

The commission announced on May 14 that it has reviewed Apple Korea’s application for a consent decision but decided to postpone commencing a consent decision process as it still had room for improvement.

"After the first round of deliberation, the applicant has made some improvements in corrective measures. But we felt that the implementation plan still lacked detailed measures for win-win growth," said a commission official.

The Korea Fair Trade Commission will decide whether to initiate a consent decision process when Apple Korea submits a specific plan for corrective measures.

A consent decision refers to a system in which the commission promptly closes a case without determining whether a company has violated law if its voluntary correction measures are deemed reasonable.

Apple Korea has been investigated by the Korea Fair Trade Commission on charges of passing on the burdens of advertisement and repair fees to Korean telecommunications companies. In July 2919, Apple Korea applied for a consent decision, saying that it will prepare corrective measures on its own.
