Facebook Slapped with 6.44 Bil. Won in Penalty Surcharge

A penalty surcharge of 6.44 billion won has been imposed on Facebook for creating and collecting face recognition templates without user consent.

The Personal Information Protection Commission imposed a fine of 29 million won and a penalty surcharge of 6.66 billion won on Facebook and Netflix on Aug. 25.

The penalty surcharge on Facebook is 6.44 billion won. “From April 2018 to September 2019, Facebook created and collected face recognition templates without user consent,” the commission explained.

It imposed a penalty surcharge of 220 million won and a fine of 3.2 million won on Netflix. The former is for having collected personal information without consent before service subscription procedure completion. The latter is for having not disclosed the content of cross-border personal information transfer.

“Although Google violated no laws, it poorly handled personal information in some cases, such as insufficient notification related to additional personal information collection and some vagueness related to cross-border personal information transfer, and we told it to address the matter,” the commission said, adding, “Our investigation on personal information collection by such foreign companies is still ongoing.”
