The First Exchange Order under South Korea’s Lemon Law

The Ministry of Land, Infrastructure and Transport has told Mercedes-Benz to exchange a defective S350d 4Matic for a new one.

The Ministry of Land, Infrastructure and Transport told Mercedes-Benz late last month to exchange an S350d 4Matic manufactured in 2019 for a new one. This is the first exchange order since the implementation of South Korea’s lemon law.

Last year, the ISG system of the car in question repeatedly malfunctioned and the owner of the car demanded exchange more than three times.

The consumer protection law took effect in 2019 so that a manufacturer provides refund or exchange in the event of its product defect. When it comes to cars, refund or exchange is possible through arbitration in the event of two critical or three general defects within a year from purchase.

More than 570 refund and exchange requests have been made since the implementation of the law. However, this case is the first case of exchange order from the ministry as mentioned above.
