Apple vs. Samsung

 

According to German patent blog FOSS Patents on July 28 (local time), Apple submitted a document to the United States Court of Appeals for the Federal Circuit, which says that it will drop a cross-appeal in its first California case against Samsung. The deadline for Apple's opening brief was July 28.

In the first patent lawsuit, the United States District Court for the Northern District of California ruled that Samsung infringed on Apple's design patents, ordering Samsung to pay US$930 million in damages for patent infringement.

In March, Apple filed a cross-appeal aiming at banning the sale of Samsung products, but withdrew the case.

However, the Korean tech giant is unlikely to drop the cross-appeal, since it is necessary for the firm to reduce the astronomical amount of indemnities, or to reverse the first court ruling against the company.

Industry analysts are saying that since Apple dropped its cross-appeal, both sides might reach an agreement. In June, the two tech companies dropped their appeal of last year’s final ITC ruling.
