Imminent Ruling

 

The US district court judge presiding over two Apple vs. Samsung patent trials in California denied a re-retrial in the patent battle. 

Judge Lucy Kohin of the Northern District of California denied both parties’ motions for judgments as a matter of law (JMOLs) on February 7 (local time), together with Samsung’s request for retrial and remittitur. 

The judge states that part of Apple’s closing argument at the November 2013 limited damages retrial was “disappointing and troubling,” which was apparently intended as an appeal to US jurors’ patriotism. However, she said that the argument did not affect the verdict at that time.

With the dismissal of a retrial, the first court ruling against Samsung to pay Apple damages worth US$930 million (1 trillion won) is expected in a few weeks, unless both sides reach an agreement.
