Payment for Patent Infringement

 

According to the San Jose Division of the U.S. District Court for the Northern District of California, Samsung Electronics is to pay Apple US$548 million as a compensation for patent infringement by Dec.14, within 10 days after a written application for payment is sent by Apple.

The payment has to do with the patent lawsuit Apple filed in April 2011 with regard to Samsung Electronics’ Galaxy S and Galaxy Tab. The amount was determined at the first trial in the San Jose Division and the appellate trial in the Federal Court of Appeal in May this year. Samsung Electronics’ request for a retrial was turned down in August.

Samsung Electronics has yet to decide whether to bring the case to the Supreme Court or not. At present, Samsung Electronics is claiming that it has the right to get back the payment depending on the result of additional litigation or the U.S. Patent and Trademark Office’s decision. Apple is claiming the other way around.

The U.S. Patent and Trademark Office has ruled that Samsung Electronics did not infringe upon Apple’s so-called pinch-to-zoom patent. However, this has no legal binding force and the patent of Apple is legally valid as of now.
